I believe the answer is:

issuer

'publisher' is the definition.
(I've seen this before)

'apparently takes action against' is the wordplay.
I cannot quite see how this works, but
'takes' could be 'is' (being is a kind of taking) and 'is' is found in the answer.
The remaining letters 'suer' is a valid word which might be clued in a way I don't see.
This may be the basis of clue (or it may be nonsense).

(Other definitions for issuer that I've seen before include "publisher" , "one responsible for 12D [PUBLICATION] ?" , "One distributing for use" , "publishing house?" .)
