'roman who's caught in flagrante?' is the wordplay.
'roman who' becomes 'qui' ('qui' is 'who' in Latin).
'caught in' means one lot of letters goes inside another.
'flagrante?' becomes 'act' (I am not sure about this - if you are sure you should give a lot more credence to this answer).
'qui' inserted into 'act' is 'ACQUIT'.

(Other definitions for acquit that I've seen before include "Release" , "Discharge from court as innocent" , "Clear of blame" , "Free - act" , "Declare to be innocent in court" .)
