I believe the answer is:
get off
'escape punishment' is the definition.
(I've seen this in another clue)
'pass out' is the wordplay.
'pass' becomes 'get' (I can't justify this - if you can you should give a lot more credence to this answer).
'out' becomes 'off' (I've seen this before).
'get'+'off'='GET OFF'
'and' acts as a link.
