Crossword Genius

Run out of road across the pond, not having planned to leave (9)

Ross

I believe the answer is:

intestate

I'm a little stuck... Click here to teach me more about this clue!

'not having planned to leave' is the definition.
(I've seen this before)

'run out of road across the pond' is the wordplay.
I cannot quite see how this works, but
'run' could be 'test' (synonyms) and 'test' is found within the answer.
'the' could be 't' (the is pronounced as a 't' sound in some dialects) and 't' is located in the answer.
This may be the basis of the clue (or it may be nonsense).

Can you help me to learn more?

(Other definitions for intestate that I've seen before include "Dying thus, one leaves no will" , "Not having planned to leave" , "dead without having made a will" , "One without will" , "Undecided about who should inherit" .)

I've seen this clue in The Telegraph.
